Background

These Terms apply as between you, the user of this Site and Bonhill Group Plc company registration number 02607995 and whose registered office is at 5th Floor 6 St Andrew Street, London, EC4A 3AE
(“we” “us”  “our”), the owner of this Site. Your agreement to comply with and be bound by these Terms is deemed to occur upon your use of our Site and upon the submission of any entry for a competition. If you do not agree to be bound by these terms and conditions, you should not enter any competition,

1. Introduction

Together with our Competition Terms and Conditions and Acceptable Use Policy, these Terms governs how you may access and use the Site.

2. Privacy

Use of the Site is also governed by our privacy policy which is incorporated into these terms and conditions by this reference. To view the Privacy Policy, please click on the link above.

3. Disclaimers

i. We make no warranty or representation that the Site will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Site.

ii. No part of this Site is intended to constitute advice and no text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Site (“Content”) on this Site should be relied upon when making any decisions or taking any action of any kind.

4. Availability of the Site

The Site is provided “as is” and on an “as available” basis.  We give no warranty that the Site will be free of defects and/or faults. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.

We accept no liability for any disruption or non-availability of the Site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

5. Indemnity

You agree to indemnify, defend and hold us harmless and, where appropriate, its officers, employees, shareholders, directors and suppliers against all claims, liability, damages, costs and expenses, including without limitation reasonable legal costs and expenses, arising out of or related to a breach of these Terms, the use of this Site.

6. Limitation of Liability

i. To the maximum extent permitted by law, we accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Site or any information contained therein. You should be aware that you use the Site and its Content at your own risk.

ii. Nothing in these Terms excludes or restricts our liability for death or personal injury resulting from any negligence or fraud on our part.

iii. Whilst every effort has been made to ensure that these Terms adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining Terms. This Terms shall apply only within jurisdictions where a particular term is illegal.

7. No Waiver

In the event that any party to these Terms fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

8. Previous Terms and Conditions

In the event of any conflict between these Terms and any prior versions thereof, the provisions of these Terms shall prevail unless it is expressly stated otherwise.

9. Law and Jurisdiction

These Terms and the relationship between you and us shall be governed by and construed in accordance with the Law of England and Wales and we and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

Competition Terms & Conditions

1. Promoter’s name and address

We are Bonhill Group Plc, with company registration number 02607995 and whose registered office is at 5th Floor 6 St Andrew Street, London, EC4A 3AE (“we” “our” “us)

2. How to participate

2.1. In order to enter one of our monthly promotions (“Promotions” and each being a “Promotion”) the participant (“you”) must enter the information requested and select the ‘submit’ button.

2.2. Please only submit material that you or your company own or are authorised to use. By submitting an application for a Promotion you confirm that all information submitted is accurate in all respects, complete and not misleading.

2.3. We accept no liability for any material submitted to us.

2.4. By entering any Promotion you hereby indemnify us and hold us harmless against any claims (however arising) for any use or display of such materials including without limitation any material published or referred to by us that infringes any intellectual property rights of any third parties.

2.5. Entries which are incomplete, misspelt, inaudible, or incomprehensible are void and will not be entered into the Promotion.

2.6. You may only enter a maximum of one Promotion per financial quarter. Any entry made in violation of this clause 2.6 (including without limitation by any connected person or other entity) will be void and will be excluded from the Promotion.

2.7 Any entries or winners who are shown to have provided inaccurate, false or misleading information will be disqualified and their entry will not be considered. In the event that they have won the competition we will not pay the prize or may be able to recall the prize and an alternative winner will be selected from the entries submitted during that period. Any company which is disqualified will not be permitted to submit any further entries.

3. Start & Closing Dates

Each Promotion will open on the start date displayed on https://britishsmallbusinessgrants.uk/ (“Website”) and all entries for the Promotion must be received by the Monthly Application Deadline on the Website (the “Cut-off date”). Any entries received after the Cut-off date may, in our discretion, be submitted in the following month’s promotion /or will be rejected.

4. Winner announcement

4.1. One (1) company shall win per Promotion (“Winner”).

4.2. Each Winner will be selected from all of the entries correctly submitted for that Promotion and shall be chosen by the panel of judges whose details will be shown on the Website, which may vary from time to time (“Judges”). The winning entry will be judged on factors including without limitation turnover growth, innovation, aspiration, key projects completed, contracts won and partnerships forged.

4.3. By entering the Promotion you acknowledge that if you are selected as the Winner your name, your image, your business idea, your intellectual property, your company and your business may be used in publicity. You agree by entering the Promotion to make yourself available to us for this purpose upon reasonably written notice, and to make yourself available for a promotional video filmed by Bonhill Group plc that will incorporate an advice session with a partner of Small Business Grants.

4.4. The Winner will be announced on the Website in the month following the Monthly Application Deadline and the winner will be notified personally as soon as practicable either before or after this date.

5. Eligibility

The competition is open to all United Kingdom registered companies which fit the following criteria (and as amended from time to time) being:

5.1. the company must be set up and actively trading; companies that do not yet exist will not be considered;

Please note the following restrictions and requirements apply:

5.3. Our employees and their immediate families are ineligible to enter the Promotions.

5.4. Any Company owned or controlled by a Judge are ineligible to enter for that Promotion

6. The prize

The prize for each Promotion is a cash deposit of £5,000 (“Prize”).

6.1. The Prize will be paid into the company’s bank account provided by you by no later than 30 days from the point at which the Winner has been announced.

6.2. The Winner must provide correct bank details and sufficient information as per eligibility criteria, as required by us to ensure payment is made.

6.3. You will be responsible for, and will account to the appropriate authorities for, all tax liabilities or similar contributions payable in respect of the prize and we take no responsibility for such tax liabilities.

7. Winner publicity

In the event that you are the Winner, you accept and agree that we have the right, without additional payment or permission, to use your name, company name, logo, submission details, address for the purposes of announcing the winner of the Promotion and for all related promotional purposes. All data will be kept in accordance with our terms and conditions including without limitation our Data Protection Policy.

In the event that you are the Winner, you must accept and agree to a filming session for a promotional video that can be used and distributed at the discretion of Bonhill Group plc and that will incorporate an advice session lasting around one hour with our promotional partner Opus Energy.

8. Entries

8.1. All entries and submissions will become our property upon receipt and will not be returned to you.

8.2. You understand and agree by entering a Promotion that upon submitting an entry you assign the copyright in your entry to us absolutely and we will own all copyright in the entry.

9. Winning entry details

The name of the winner [and the winning entry] will be sent to anyone who writes to us at the address above, within 3 months of the Winner being announced provided you enclose a stamped addressed envelope and mark your request as “requesting details of the winning entry” with the closing date of the Promotion.

10. Data privacy

We would like to keep you informed of similar products and future business opportunities, including funding methods, and advice for small businesses through our weekly email newsletter ‘businessGO’, and by email, post and/or telephone. Additionally, we would also like to invite you by email and over the phone to relevant Smallbusiness.co.uk events, which include British Small Business Awards and other relevant events associated with SmallBusiness.co.uk. Please write to us at the address above if you specifically do not want to receive this information by email or you can email us at digitalteam@bonhillplc.com. You will also have the opportunity of unsubscribing to our newsletter.

We will not pass your email address to third parties for marketing purposes, however, by submitting an entry in a Promotion you provide us with your consent to permit these details to be passed on to our Judges and sponsors who may contact you to discuss further support or their services.

11. Rules

These rules of entry may vary from time to time, to reflect amongst other things differences in the promotion mechanic, in the prizes and in eligibility criteria. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the English Courts.
